1. Scope
These Terms of Service govern access to and use of LensDeliver.
LensDeliver is a software product used to create, manage, publish, and deliver private client galleries and related workflows.
The service is currently offered in beta and primarily intended for professional and business use.
Public gallery viewers are not parties to the service agreement with LensDeliver. They may only access gallery content within the permissions configured by the account owner.
2. Beta status
LensDeliver is currently made available as a beta product.
Features, availability, workflows, and interfaces may change during the beta period.
Some parts of the product may be incomplete, temporarily unavailable, or replaced without backward compatibility.
By using the beta, the customer accepts the operational risk of testing a product that is still evolving.
3. Accounts and access
Access to the application may require account registration and acceptance of these Terms.
LensDeliver may offer login by email and password and login through Google, where available.
Email-and-password registration may require email verification before account activation.
The customer is responsible for account security, password protection, session handling, and access granted to other users.
LensDeliver may suspend or restrict access if this is necessary for security, abuse prevention, legal compliance, or service stability.
4. Permitted use
The customer must use LensDeliver lawfully and in accordance with these Terms, the Privacy Policy, and any in-product instructions.
The customer remains responsible for all content uploaded to the service, including gallery files, messages, client data, and sharing configuration.
The customer must not upload unlawful content, excessive data, or content that infringes third-party rights.
The customer is responsible for having an appropriate legal basis to process the personal data of clients, gallery recipients, and other end users.
5. Service features
During beta, LensDeliver may provide features including:
account and tenant management,
album and gallery creation,
draft, preview, publish, deactivate, and reactivate flows,
public gallery delivery,
access control features such as private links and PIN protection,
storage, upload, download, and ZIP-related workflows,
operational email sending and delivery tracking,
basic usage and operational event history.
Feature availability may vary by account, configuration, or beta rollout state.
6. Limits and protections
LensDeliver may apply technical and operational limits, including storage limits, upload limits, email limits, rate limits, and session limits.
If limits are reached, LensDeliver may block uploads, gallery creation, email sending, or other selected features until the condition is resolved.
LensDeliver may also apply emergency switches or safeguards where needed to protect infrastructure, data, or service continuity.
7. Availability and changes
LensDeliver may carry out maintenance, upgrades, migrations, and security actions.
During beta, interruptions or temporary restrictions may occur without prior notice when reasonably necessary for security, stability, or cost control.
LensDeliver may change the service, interface, or workflows over time.
8. Customer data and galleries
The customer determines when a gallery is published, who receives access, and how long access remains active.
LensDeliver may provide internal preview functionality before public publication.
Gallery recipients may access a gallery only within the sharing settings configured by the customer.
The customer remains responsible for the content shared with end recipients and for how links, PINs, and delivery communications are used.
9. Retention and account closure
The customer may request account deletion or use any account-deletion mechanism made available in the product.
Deletion of an account does not necessarily result in immediate deletion of all data from technical backups, logs, or temporary operational systems.
LensDeliver may retain some data for security, compliance, billing, dispute handling, backup, and controlled deletion workflows, as described in the Privacy Policy and technical documentation.
10. Third-party providers
LensDeliver relies on third-party infrastructure and service providers for hosting, storage, database, email delivery, analytics, authentication, and related technical operations.
Use of third-party providers may affect service availability, data routing, or transfer mechanisms.
A current operational register of subprocessors is maintained separately.
11. Liability
LensDeliver is provided with reasonable care, but during beta no guarantee is made that the service will be error-free, uninterrupted, or fully suitable for every workflow.
LensDeliver is not liable for:
misuse of the service,
data loss caused by the customer's own actions or by persons to whom the customer granted access,
temporary interruptions, feature limitations, or beta-related instability,
third-party provider failures, except where liability cannot lawfully be excluded.
Nothing in these Terms excludes liability where exclusion is prohibited by mandatory law.
12. Privacy and data processing
Information about personal data processing is described in the Privacy Policy.
For account, billing, security, and operational data, LensDeliver acts as controller.
For customer-uploaded client data and gallery content, LensDeliver typically acts as processor or service provider to the customer, subject to the applicable DPA and service configuration.
13. Governing law
These Terms are governed by Polish law, unless mandatory law requires otherwise.
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
